Hirers are reminded paying your deposit or balance you are agreeing to Lancashire Classic Jaguar Hire Ltd self drive hire terms and conditions. If there is anything you do not understand or do not agree with, please have your query clarified with your point of contact.
CONFIRMATION OF BOOKING
To confirm a booking for a classic car and the hire date we require you to pay Lancashire Classic Jaguar Hire Ltd a non refundable booking fee of 25% of the hire cost, the remaining balance will be due sixty days before day of driving.
If the booking is made less than sixty days before the day of driving payment is required in full.
If booking a Luxury Classic Car Break or any other offer payment in full is required at time of booking and this is non re-fundable.
All payment for self drive hire must be made by Paypal or major credit / debit cards only.
CONDITIONS FOR USING THE VEHICLE
Only you or a named driver on the insurance cover note may drive the vehicle providing a full valid driving licence is held and a cover note has been issued to you.
You or your authorised named driver must not:
Use the vehicle for hire or reward.
Use the vehicle for any illegal purpose.
Use the vehicle for racing, pace making, testing the vehicle’s reliability and speed or teaching someone to drive.
Use the vehicle while under the influence of alcohol or drugs.
Drive the vehicle outside England, Scotland and Wales, unless we have given you written permission.
Load the vehicle beyond the manufacturer’s maximum weight recommendations and make sure that the load is secured safely.
If the vehicle is a commercial vehicle, use it for a purpose for which you need an operator’s licence if you do not have one.
You or your authorised named driver must not use the vehicle for towing unless we have given you written permission.
SECURITY BOND & INSURANCE EXCESS
When paying for the booking we will require a Security Bond / Insurance Excess (SB/IE), this must be made by Paypal or major credit / debit cards only.
This will need to be paid 7-14 days before the day of driving. Each SB/IE varies depending on the value and power of the hired vehicle.
This money is taken to use as a Security Bond, to cover any damage to the vehicle not covered by the Insurance Excess. The Insurance Excess for any accidental damage, loss or theft caused to the vehicle by the hirer, plus any additional charges acquired by the hirer. Excess Mileage, Parking tickets, Speeding fines, Petrol surcharges and fuel cost etc.
Provided the vehicle is returned to us at the end of the hire in the same condition as at the start of the hire (excepting normal wear and tear) a full refund of the SB/IE will be made.
If any charges arise after the SB/IE has been returned which relate to the hire of your vehicle, you will be responsible for them
with in seven days.
All drivers must be in possession of a current, full valid driving licence. UK Licence holders, with the new style driving licence MUST produce both the photo card and the paper counterpart. Drivers with foreign driving licences must present their own national licence, plus an International Driving Permit (IDP) if a non-EU, EEA resident. All other drivers may drive in the UK for up to one year from commencement of residency in accordance with the current DVLA restrictions but a valid passport, confirming proof of entry is required.
Your full UK Driving Licence must be produced each and every time you hire a vehicle from us. In addition, you must produce one other form of identification, which can be your passport or a recent utility bill. You will also be required to leave a landline / mobile telephone number where you can be contacted either during the day or evening.
Note: Our rental staff reserve the right to refuse your rental if you do not produce your driving licence.
DRIVER ELIGIBILITY AND RESTRICTIONS
Only those persons named on the insurance policy are eligible to drive the hired classic car. All drivers must be aged between 30 and 70 years old and have held a full driving licence for more than 3 years at the start date of the hire and have no more than six penalty points in the last 5 years. You must advise us prior to the start of your hire of any motoring offences or accidents incurred by the driver in the last 5 years.
If you have any penalty points or been involved in any accidents which cause an insurance loading on the insurance policy the driver is responsible for paying the loading premium.
Whilst every effort will be made to provide the exact make and model reserved, in some circumstances it may be necessary to offer a similar vehicle in place of the reserved vehicle.
In addition to the main hirer, it is possible for two other hirers to be insured to drive the vehicle, provided they meet our insurance requirements. One SB/IE is required from the main hirer.
(Additional driver cost is £55.00 GBP per person.)
Our rental staff will note on the pre-rental check form and rental agreement, the reading of the fuel gauge. You are requested to return the vehicle with the same amount of fuel as at the start of the rental. A re-fuelling surcharge will be made if it is necessary to bring the level of fuel up to where it was when you took the vehicle. No refund will be given for any fuel in excess of the original reading.
This is calculated on the hire length you have chosen. Rental times may be adjusted to suit individual hirers' requirements subject to vehicle availability.
You must look after the vehicle and the keys to the vehicle.
You must always lock the vehicle when you are not using it, and use any security device fitted to or supplied with the vehicle. You must always protect the vehicle against bad weather, which can cause damage.
You must make sure that you use the correct fuel, as you are responsible for any resultant damage. You must not sell, rent, or dispose of the vehicle or any of its parts.
You must not give anyone any legal rights over the vehicle.
You must not let anyone work on the vehicle without our permission. If we do give you permission, we will only give you a refund if you have a receipt for the work.
You must let us know as soon as you become aware of a fault in the vehicle.
If you cancel your booking within 30 days of the agreed hire period we will charge you a 90% cancellation fee as it is unlikely that we can fill that date with another hire.
For cancellations made within 30 -60 days of agreed hire period a charge of 75% of the full hire cost will be made .We reserve the right to cancel a hire booking at or before the start time should the weather conditions in our sole opinion present a risk to your safety and or the safe keeping of the classic car. You may then choose to rearrange the hire date.
Should we have to cancel the hire for any other reason, we will give you as much notice as possible and will offer you the choice of a full refund of the amount paid by you, an alternative classic car or alternative hire dates.
We may at our option extend the hire period at your request, subject to your payment of the agreed additional hire charges.
Gift vouchers purchased from us, paid in full pending hire dates do not qualify for refunds of any type.
If booking a Luxury Classic Car Break or any other of Lancashire Classic Jaguar Hires Special Offers payment in full is required at time of booking, this is non-refundable.
RETURNING RENTAL VEHICLES
Before you bring back the vehicle you must check that you have not left any personal belongings in the vehicle. Vehicles must always be returned back to us during opening hours. We will not accept responsibility for vehicles damaged or stolen from outside our premises if dropped-off after hours. If we have agreed that you may return the vehicle outside business hours, you will remain responsible for the vehicle and its condition until it is re-inspected by a member of our staff.
If you do not bring the vehicle back on time you are breaking the conditions of this agreement. We will charge you for every day or part thereof you have the vehicle after you should have returned it to us. Until we get the vehicle returned to us or collected, we will charge you the current daily rental rate.
If we have to re-cover the vehicle from where you have left it you will be responsible for the recovery cost.
YOU WILL HAVE TO PAY FOR REASONABLE COSTS OF REPAIR IF
We have to pay extra costs to return the vehicle to its condition when the pre-rental inspection was carried out (for example, if extra valeting time or special material or equipment is needed to restore the vehicle to its pre-rental condition) or, if the vehicle has been damaged whilst in your care.
WHAT TO DO IF YOU HAVE AN ACCIDENT
If you have an incident you must not admit responsibility. You should get the names and addresses of everyone involved, including witnesses. You should also:
Make the vehicle secure.
Tell the police straight away if anyone is injured or another car was involved or there is disagreement over who is responsible; and call our office straight away, and advise us what has happened.
If possible take as many photos of the car / scene as possible.
You must then fill in our incident report form when you return the vehicle or if this is not possible, verbal details will be taken from you to then sign a copy of the information you have supplied. In any event this procedure must be actioned within 24 hours whichever is sooner.
You agree to pay to us both the agreed hire charges and any payments that fall due to us in the following circumstances:-
Any surcharge imposed by our insurers by reference to the driving record or circumstances of yourself or a nominated driver, or any unusual hire details.
The cost of fuel plus a surcharge of £30.00 if you do not return the vehicle with a full tank of the correct fuel, unless previously agreed. If you refill the vehicle with the wrong fuel in breach of our instructions, all costs incurred by us in having the fuel system cleaned or of rectifying any resultant damage to the classic car. You should also note that if you are late returning the classic car you may become uninsured and in that event will be solely responsible for any loss, damage or injury resulting from an accident taking place, for which you will be required to indemnify us in full.
Breakdown covers against the eventuality of mechanical failure or breakdown of the car. This does not allow the use of the breakdown to change a wheel with a flat tyre or if you run out of fuel. If you call them out for either wheel change assistance or re-fueling there is a £150.00 surcharge.
We have maintained the vehicle to at least the manufacturer’s recommended standard. We assure you that the vehicle is roadworthy and suitable for renting at the start of the rental period. We are only responsible for loss or damage to property left in the vehicle if the loss or damage results from our negligence or a breach of contract.
ENDING THE AGREEMENT:
We may terminate this agreement at any time if you do not meet the main requirements of this agreement. If we end this agreement it will not affect our right to receive any money we are owed under the conditions of this agreement. We can also claim reasonable costs from you if you do not meet the main requirements of this agreement.
You agree that we may use any information you have given us to carry out our own market research. If you break the agreement we can give this information to credit reference agencies, the Driver and Vehicle Licensing Authority (DVLA), debt collectors and any other relevant organisations. We can also give this information to our Insurance Brokers who may inform the British Vehicle Rental and Leasing Association (BVRLA), who can pass it on to any of its members for any purpose shown in the Data Protection Act 1998.
We will be under no liability to you or any third party for any loss of business, loss of profits or any other consequential loss arising out of or in connection with your use of (or inability to use) the classic car under the Hire Agreement. You agree to indemnify us in respect of any loss, claim, liability, damage or expense incurred by us arising from your failure to observe any of these Terms and Conditions or of the Hire Agreement. You will be responsible for safe keeping of any property belonging to yourself, any nominated driver or passenger in the classic car during the hire period, and we will not be responsible for theft or loss of any such property. Any property of yours that is left with us on our premises during your hire period will remain your responsibility and we will not be liable in any way, in the event of theft or loss. For the purposes of the Data Protection legislation for the time being you consent that we may hold and process by computer or otherwise any information provided by you to us to enable us to identify other products or services which may be relevant to you for statistical analysis. We reserve the right to decline any prospective client, driver or individual hire arrangement, whether by reason of driving record, accident history, creditworthiness or any other reason We reserve the right to change our specific classic cars at any time, but would contact and advise anyone with a pending hire that may be affected by such a change, prior to your hire date. Irrespective of where you are resident or where the initial booking was made, the Hire Agreement and these Terms and Conditions will be governed by English law. The Hire Agreement must be signed by you or your nominated driver at the point of delivery and collection of the classic car. No amendment to these terms or any other part of this Contract will be effective unless recorded in writing and signed by you and a representitive of Lancashire Classic Jaguar Hire Ltd.
By booking or signing the Hire Agreement on the day you accept responsibility for the personal information you provide about yourself and any nominated driver, and accept Lancashire Classic Jaguar Hire Ltd Terms and Conditions.
Please note that cover is subject to the expiry date on the cover note, if this date and time is overlapped with the return of the vehicle, contact must be made with the hire company to extend cover to ensure continuation of insurance cover.
1. ARRIVAL: Your car will arrive at the appointed time unless we are unable to do so due to circumstances beyond our control. In that case the company shall notify the booker as soon as possible.
2. AUTHORITY: The driver is authorised by us to stop the car and ask any passengers to leave the vehicle if, in his opinion, customers are acting contrary to our conditions of service in any way.
Passengers must not distract or encourage or harass the driver into breaking the law or any of these conditions.
3. DAMAGE: Any malicious damage or deliberate breakages or carelessness resulting in damage to the vehicle will be charged directly to the customer who placed the booking.
4. SOILING: Any passenger causing excessive soiling inside the vehicle will be charged for valeting of the vehicle. Excessive soiling is when the car is unusable for the next client and cannot be easily rectified by the driver with equipment provided in the vehicle. If valeting is required this will be invoiced to the customer.
5. LICENSING/INSURANCE: All our Jaguars are Chauffer Driven only.
We will not carry more passengers than our insurance allows.
6. SMOKING: We have a NON-smoking policy for all our cars in line with health and safety legislation. Smoking in the cars is not permitted and will not be tolerated. In such circumstances the driver has the authority to ask passengers to leave the Jaguar.
7. FOOD/DRINK: We also have a NON-food/drink policy for all our cars. Again, in such circumstances the driver has the authority to ask passengers to leave the Jaguar.
8. SUBSTITUTION: We reserve the right to substitute any Jaguar in the event of a breakdown prior to any booking. We will endeavour to supply a vehicle of equal quality but if this is not possible we will make an adjustment to the price accordingly. If the car should breakdown during your journey the driver will contact us to arrange a car to get you to your destination as soon as practical. Be assured your safety, comfort and punctuality is our utmost priority.
9.BOOKING CONFIRMATION: Your booking is not secured until you receive a confirmation. This will be by letter, fax or e-mail. Please check your booking confirmation carefully and inform us of any errors immediately. We will endeavour to check all details, including pick-up, drop-off and journey times etc. given to us. Lancashire Classic Jaguar Hire cannot be responsible for any errors, cancellations, road works, traffic-jams or timetable or schedule changes which result in loss or delay to our customers or passengers.
10.DEPARTURE TIMES: We will recommend departure and journey times to be allowed for after making allowances for the day of travel and times. Lancashire Classic Jaguar Hire cannot be held responsible for clients insistence for any variation to the recommended times or delay to agreed pick-up time which may result in missing your special event start times or any other loss. Any delay during a journey caused by the passenger is solely at his or her own risk and responsibility. The driver must not be asked to speed or drive recklessly to make up time.
11.QUOTES: A Quote can be verbal, in writing or by e-mail and will be based on information supplied by our customer. The quote will be considered as binding by Lancashire Classic Jaguar Hire, subject to these terms and will be valid for 1 month. Any change to the arrangements could render the quote invalid, in such circumstances.
12.CHANGES WHILST IN TRANSIT: Requested changes, including requests to carry luggage, at the time of travel will be subject to an additional charge up to and not more than our standard charge of £50, payable on completion of your journey. Any such changes will need to be agreed with the proprietors of Lancashire Classic Jaguar Hire and not the vehicle driver.
13.LIABILITY: Every effort will be made to get you to your destination on time, but we are not liable for any loss due to delays caused by traffic jams, road works, road closures, diversions, extreme weather conditions, collisions caused by other parties, mechanical breakdown or terrorist attacks on the journey. Lancashire Classic Jaguar Hire may cancel all services and refund in the event of a declared national emergency, riot, war, fuel shortage, extreme weather, nuclear explosion or leakage and terrorist attack. In the unfortunate event of mechanical breakdown, taxi fares will be fully re-imbursed and the cost of hire for the Jaguar either fully or partly refunded, depending on circumstances. Lancashire Classic Jaguar Hire will not be held responsible or liable for any arising consequential losses and any liability on our part will be limited to the money paid by the client.
14.TERMINATION: Lancashire Classic Jaguar Hire reserves the right to refuse or terminate any booking if it is felt to be not genuine or places any driver or vehicle at risk of damage or abuse by the client or by persons (connected or not connected with the client) in the vicinity of any location during the hire. The vehicle will leave the vicinity of any disturbance whether the client is present or not and only return when safe to do so. Lancashire Classic Jaguar Hire reserve the right to terminate the agreed arrangement with immediate effect and ask the customer to vacate its vehicle (when safe to do so) if at the driver’s discretion, the client commits any act which threatens the safety of the vehicle or any of its occupants. There will be no refund if part way through the journey or a later return journey is unused. A passenger will be refused entry to any of our vehicles if the driver suspects drug, alcohol or solvent abuse prior to or during the journey.
15.PAYMENT:We reserve the right to ask for full payment of the agreed amount at the time of booking. This is to be made by cheque payable to Lancashire Classic Jaguar Hire Ltd (which must be cleared by the time of travel). When a booking is made a non refundable booking fee of 25% per car is to be paid, the balance owing is to be paid 60 days in advance of travelling. For short notice bookings (if less than 60 days from travelling) payment in full at time of booking is required. Booking confirmation will be sent once payment has been received.

16.CANCELLATION: Once confirmed, if you decide not to proceed with your booking, you need to notify us at least 1 month prior to the date of travel. Balance payments are refundable if we can refill the booking date for that Jaguar. Wedding deposits are excluded and are non refundable.
Cancellations less than 1 month are non-refundable. Cancellations are only acceptable by letter or by e-mail. Where payment in full is required and made to receive a special offer, these payments are not refundable in any circumstances.
17.CAPACITIES: The number of persons the hire vehicle can carry will be advised at the time of booking and we will not guarantee to carry all other associated items e.g. luggage, personal possessions. These need to be notified to us at the time of booking to avoid unnecessary delay and expense. The only journeys carried out will be stated on the Booking form.
18. ANIMALS: No animals whatsoever will be taken in any Jaguar with the exemption of guide dogs, this must be arranged beforehand and is on the booking form.
19 PERSONAL PROPERTY: We will not be held responsible for loss or damage to personal property left in our Jaguars unless loss or damage results from our negligence.
20.JURISDICTION: The conditions set out above and all other expressed by Lancashire Classic Jaguar Hire are Terms of Contract, these shall be governed and is construed in accordance with the laws of England and Northern Ireland. By making a booking the client agrees to the above-mentioned terms and conditions
